Charleston man arrested on tax charges
Marty Duval Horry, a Mount Pleasant resident, was arrested Thursday morning on tax related charges.
South Carolina Department of Revenue investigators charged Horry, 32, with one count of assisting in the preparation of a fraudulent return and one count of forgery.
In 2010, Horry provided a 2009 W-2 form to the tax preparer BKS Tax Service that stated he had wages of $14,530.75, Federal withholding taxes of $1,459.61 and SC withholding taxes of $717.15. Evidence from his employer revealed Horry actually had wages of $1,151.39, Federal withholding taxes of $9.60 and SC withholding taxes of $48.26. The use of the fraudulent W-2 form resulted in the defendant receiving fraudulent income tax refunds.
For willfully assisting in the preparation of a false return, Horry could face up to five years in prison and/or fines of up to $500 if convicted of the charges. By presenting a W-2 form to his tax preparer, the defendant committed forgery and could face up to 10 years in prison and/or be fined in the discretion of the court, if convicted of the charges.
