DOR Investigators arrest Mount Pleasant man
Derrick Lamont Nelson, Sr., 30, was arrested today on tax related charges.
South Carolina Department of Revenue investigators charged Nelson, of 1692 Snowden Road, with one count of assisting in the preparation of a fraudulent return and one count of forgery.
In 2010, Nelson presented a 2009 W-2 form from Oakland Wings, LLC to a tax preparation business, which was used to prepare 2009 Federal and SC income tax returns for the defendant. The W-2 form provided stated that Nelson had wages of $14,531.00, Federal withholding taxes of $1,460.00 and SC withholding taxes of $717.00. Evidence from Oakland Wings, LLC revealed that Nelson was never employed there. The use of the fraudulent W-2 form resulted in the defendant claiming and receiving fraudulent SC and Federal income tax refunds for the year 2009 to which he was not entitled. By presenting a fraudulent W-2 form to the tax preparer to have his 2009 tax return prepared, the defendant willfully assisted in the preparation of a false or fraudulent return. By presenting a W-2 form to the tax preparer that he knew to be fraudulent, the defendant committed the crime of forgery.
For willfully assisting in the preparation of a false return, Nelson could face up to five years in prison and/or fines of up to $500 if convicted of the charges. For the crime of forgery, Nelson could face up to 10 years in prison and/or be fined in the discretion of the court, if convicted of the charges.
